Both the USA citizen and the Thai fiancee must be legally able to marry. For example, if either person is in the middle of divorce or annulment proceedings, documents proving that you have completed those proceedings must be submitted.
The USA citizen must be able to prove that they have a genuine interest to get married within 90 days of the Thai arrival in the United States.
